MOOV360 Terms of Use for Text Messaging
By "Opting In" to or using a "Text Messaging Service" (as defined below) from MOOV360, you accept these Terms of Use.
This agreement is between you and MOOV360 or one of its affiliates. All references to "MOOV360," "we," "our," or "us" refer to MOOV360.
Definitions
"Opting In," "Opt In," and "Opt-In" refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.
"Text Messaging Service" ("Service") includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).
Consenting to Text Messaging
By consenting to receive Service from us, you agree to these Terms of Use for Text Messaging, as well as the MOOV360 Terms of Use and MOOV360 Privacy Policy, incorporated herein by reference.
E-Sign Disclosure
By agreeing to receive this Service for text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.
MOOV360 Text Messaging Service Privacy Policy
This Privacy Policy (the "Policy") governs how MOOV360 treats the Personal Information that we collect and receive from you in connection with your use of the Text Messaging Service ("Service"), which we make available to you through a third-party service provider. This Policy is incorporated into the Terms of Use. By using the Service, you agree to the terms of this Policy.
"Personal Information" is information that individually identifies you, such as your mobile phone number, as well as any Personal Information that you choose to include in messages you send through the Service.
How We Use Your Personal Information
We only use information you provide through this Service to transmit your text messages and respond to you. This includes, but isn't limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. You should note that in using the Service, your information will travel through third party infrastructures which are not under our control (such as a third party SMS delivery platform or your carrier network).
We cannot protect, nor does this Policy apply to, any information that you transmit to other users. You should never transmit personal or identifying information to other users.
Nonetheless, MOOV360 reserves the right always to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. This Policy applies to your use of the Service and isn't intended to modify the MOOV360 Privacy Policy, incorporated by reference above, which may govern the relationship between you and us in other contexts.
Costs of Text Messages
We do not charge you for the messages you send and receive via this Service. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.
Frequency of Text Messages
This Service is for conversational person-to-person communication between you and MOOV360 and its staff. We may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as by sending a HELP request).
Opting In
A user might opt-in by:

Opting Out of Text Messages
If you no longer want to receive text messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. As a person-to-person communication service, opt-out requests are specific to each conversation between you and MOOV360 and their associated phone number. After unsubscribing, MOOV360 may send you confirmation of your opt-out via text message.
Children's Privacy
This Service is not intended for use by individuals under the age of 16. We do not knowingly collect personal information from children without parental consent. If you believe we have collected information from a child, please contact your attorney and ask to have it removed.
Changes to Privacy Policy
MOOV360 may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. Any updates will be posted on our website at https://moov360.health.
